Privacy Policy

This is the plain-English version of how I handle your information. No dark patterns, no sold lists, no surprise robocalls. If anything here isn't clear, text me at 865-803-6201 and I'll explain it.
1. Who this policy is from
This privacy policy describes how Jessica Hilary Kilgore — known professionally as Hilary Kilgore, REALTOR® (Tennessee license #355197) — handles information collected through hilarykilgore.com.
Hilary is an independent real estate agent affiliated with Greater Impact Realty Knoxville, 420 Bearden Rd, Knoxville, TN 37919, a Tennessee-licensed real estate firm. Greater Impact Realty Knoxville is the broker of record for all real estate transactions Hilary represents. When you submit a form on this site, your information is received and used by Hilary directly. Greater Impact Realty Knoxville, as the supervising brokerage, may also have access to records associated with a real estate transaction as required by Tennessee real estate law.
"I," "me," and "my" in this policy refer to Hilary. "You" means the person interacting with the website.
2. What I collect
2a. Information you give me
When you fill out a form on hilarykilgore.com, I receive whatever you choose to put in the fields. Depending on the form, that can include:
- Your name (first and last, or whatever you enter)
- Your email address
- Your phone number (optional on most forms; required only if you ask me to call or text you)
- Your message — whatever you type in the comment or notes field
- Property address (only on the "Request a CMA" form, where it's the entire point)
- Move timeline, budget hints, or other context you choose to share
- Whether you're already working with a Realtor (open-house feedback form only)
- Your consent record — if you check the "I agree to be contacted" box on a form, I store the fact that you checked it, the exact wording you saw, and the timestamp
I do not ask for, and you should not enter, sensitive information like Social Security numbers, bank account numbers, or credit card numbers anywhere on this website. If a real estate transaction reaches the stage where that information is needed, you will share it directly with a title company, lender, or escrow service — never through a public web form on my site.
2b. Information collected automatically
Like most websites, mine collects a small amount of technical information automatically when you visit:
- IP address (which my hosting provider, Netlify, logs briefly for security and abuse prevention)
- Browser type, operating system, and screen size
- Pages you visit, in what order, and how long you stay (via Google Analytics 4)
- Where you came from (the referring website or search result, if any)
- The links you click on the site, including outbound clicks to the listings site at hilary.homesineasttennessee.com
This automatic data is collected in aggregate and is not tied to your name, email, or phone unless you also fill out a form during the same visit. Even then, the form data and the analytics data live in separate systems and are not joined together by default.
3. Why I collect it
Short version: so I can answer your message, do the real estate work you've asked me to do, and improve the website.
Longer version — the legitimate business purposes for which I use the information you provide:
- To respond to you. If you ask a question, request a CMA, or sign up for the relocation guide, I use your contact information to reply.
- To deliver the real estate service you requested. Buyer consultations, listing preparation, market analyses, neighborhood research, and so on.
- To follow up with you over a reasonable period of time, by the channels you have consented to (see Section 5 for the rules around calls and texts specifically).
- To comply with Tennessee real estate law and brokerage record-keeping requirements. Transaction-related communications and documents are retained per Tennessee Real Estate Commission rules.
- To improve the website. Aggregated, anonymous analytics help me see which neighborhood pages and blog posts are useful and which need rewriting.
- To prevent fraud, spam, and abuse. Honeypot fields and basic server logs catch automated submissions.
I do not sell your information. I do not rent it. I do not trade it. I do not share it with lead-generation marketplaces, "trusted partners," lender networks, or anyone else paying for real-estate leads. Your information stays with me and, where the supervising brokerage requires it, with Greater Impact Realty Knoxville.
4. Who has access
The information you submit through hilarykilgore.com is handled by the following people and services:
- Hilary Kilgore — me, directly. Every form submission is emailed to my personal business inbox.
- Greater Impact Realty Knoxville — my supervising brokerage. They may access transaction records as required by Tennessee real estate law.
- Netlify, Inc. — my website host. Netlify operates the form submission infrastructure and stores submissions in its dashboard for as long as the form is active. Their privacy practices are at netlify.com/privacy.
- Google LLC (Google Analytics 4 & Google Tag Manager) — aggregate, anonymous traffic analytics. Configured with IP anonymization where available. Google's privacy practices are at policies.google.com/privacy.
- Google Search Console — shows me which search queries lead people to the site. Does not see individual user data; only aggregate query statistics.
I also operate a separate listings search site at hilary.homesineasttennessee.com provided by my brokerage's CRM vendor, CINC. If you create a saved-search account or "favorite a home" on that site, you are creating a separate account governed by CINC's privacy practices (linked from that site's footer). The two sites do not share form data.
5. Phone calls & text messages (TCPA)
Federal law (the Telephone Consumer Protection Act, or TCPA) requires me to get your express written consent before contacting you about real estate services by phone call or text message. I take this seriously — both because it's the law and because nobody enjoys spam calls.
5a. How consent works on this site
Forms on hilarykilgore.com that collect a phone number include a checkbox that reads:
If you check that box and submit a phone number, you are giving me express written consent to contact you via phone call and text for real estate purposes. If you don't check it, I will only contact you by email — and only in response to your message.
5b. STOP and HELP
You can opt out of text messages from me at any time, for any reason or no reason, by replying with the word STOP to any text I send you. Once you do, I will not text you again from that number unless you re-opt-in.
If you reply HELP, I'll text back with a short message identifying myself and confirming how to opt out.
5c. Frequency & carrier disclosures
- Message frequency varies. I'm a single human, not an autodialer. Most clients hear from me once or twice a week during an active search or transaction, and rarely outside of that.
- Message and data rates may apply per your wireless carrier's plan. I do not charge for any message; your carrier may.
- I do not use an automatic telephone dialing system (ATDS) or pre-recorded voice messages for marketing calls. When I call you, it is me, dialing your number on a phone.
5d. Revoking consent
You can revoke your consent for calls or texts at any time by replying STOP to a text, asking me on a call, or emailing hello@hilarykilgore.com with the word "unsubscribe" in the subject line. Revocation takes effect within a reasonable time — usually immediately, and in no case longer than 10 business days.
6. Email (CAN-SPAM)
If you give me your email address, I will use it to reply to your message and to follow up if relevant. I do not run an automated email marketing list, and I do not enroll you in any drip campaign. The blog has an RSS feed if you want to subscribe to new posts on your own terms; there is no email newsletter sign-up.
If I ever do send a broader email — say, a market update once a quarter — it will include a clear unsubscribe link as required by the federal CAN-SPAM Act. You can also opt out at any time by replying to any email of mine with "unsubscribe" in the body or subject.
7. Cookies & analytics
hilarykilgore.com uses a small number of cookies and similar technologies:
- Google Analytics 4 sets cookies (typically
_gaand_ga_*) to measure visits anonymously. These cookies expire after up to two years. You can opt out of GA tracking by installing Google's opt-out browser add-on. - Google Tag Manager is the container that loads GA4 and is configured to fire a "lead" event when you click on the CINC listings link or submit a contact form. It does not itself store personal information.
- Netlify may set a cookie to associate your form submission with the site's host. This is operational, not behavioral.
You can disable cookies entirely in your browser settings. The site will still function; only the anonymous traffic measurement will be affected.
8. Your rights
Even though Tennessee doesn't currently have a state-level comprehensive privacy law (as of the effective date above), I voluntarily extend the following rights to anyone who has interacted with this site:
- Access. You can ask me what information I have about you and I will respond within a reasonable time, usually under 30 days.
- Correction. If something I have on file is wrong, ask me to fix it.
- Deletion. You can ask me to delete your contact information. If we have an active real estate transaction or are within the brokerage's required retention window for closed transactions, I may need to keep transaction records to comply with Tennessee real estate law — but I will delete everything outside that window.
- Opt-out. You can opt out of calls, texts, emails, or any combination, at any time, and your decision will be respected.
- Data portability. If you want a copy of the information I have on you, I'll send it.

9. How I keep it safe
Realistic disclosure: I am one person running a real estate practice, not a Fortune 500 company with a chief information security officer. Here's what I actually do:
- Form submissions are transmitted to my host over HTTPS (TLS).
- My business email uses strong passwords and multi-factor authentication.
- Form submissions are stored on Netlify's infrastructure, which is SOC 2 Type II compliant.
- I do not download client contact information into spreadsheets that travel on unencrypted devices.
- For active real estate transactions, sensitive documents move through the brokerage's secure transaction management system, not through email attachments where possible.
If there is ever a data breach affecting your information, I will tell you, and I will tell you within a timeframe consistent with applicable law.
10. Children's privacy
This website is for adults considering, buying, or selling real estate. I do not knowingly collect personal information from anyone under the age of 13, in accordance with the federal Children's Online Privacy Protection Act (COPPA). If you believe a child has submitted information through one of my forms, please email hello@hilarykilgore.com and I will delete it.
11. Changes to this policy
If I update this policy materially — meaning a real change to what I collect or who has access — I will update the "Effective" and "Last updated" dates at the top of this page and add a brief note describing the change. For minor edits (typos, clarifications) I will update the "Last updated" date but leave the "Effective" date alone.
